These Terms & Conditions govern your use of www.finibrand.com and purchases made directly through this website. The website is operated by FINI Holding Corporation, referred to in these terms as “FINI,” “we,” “us,” or “our.”

By using our website or placing an order, you agree to these terms and the policies referenced below. If you do not agree, please discontinue use of the website.

1. Eligibility and Account Information

You must be legally able to enter into a binding contract to place an order.

You agree to provide accurate, complete, and current contact, billing, payment, and shipping information. You must be authorized to use the payment method submitted.

If you create an account, you are responsible for protecting your login credentials and notifying FINI of unauthorized use.

2. Products and Availability

FINI offers footwear, handbags, and accessories, including ready-made products, limited releases, and made-to-order products.

Products are subject to availability. Adding an item to your cart does not reserve it.

We make reasonable efforts to display product colors, materials, dimensions, and details accurately. Screen settings and lighting may affect how colors appear. Handcrafted products and natural materials may have minor variations in texture, finish, or appearance. This does not limit your rights concerning defective or incorrectly described products.

Product-specific conditions, including production timelines and clearly disclosed final-sale restrictions, will be shown on the relevant product page or at checkout.

3. Orders and Acceptance

An order confirmation acknowledges receipt of your order; it does not guarantee acceptance or availability.

We may decline or cancel an order because of unavailable inventory, inaccurate product or pricing information, suspected fraud, payment issues, or other lawful reasons. We may also limit quantities purchased by a customer or shipped to an address.

If we cancel an order after collecting payment, we will refund the amount paid for the canceled items and any associated charges that must be refunded.

4. Payment

Payment is collected at checkout, including for made-to-order products, unless a different payment arrangement is expressly disclosed before purchase.

Available payment methods are displayed at checkout. Payments are subject to authorization and any applicable terms of the payment provider.

FINI does not obtain consumer credit reports as part of an ordinary purchase. Payment providers offering financing or installment payments may apply their own eligibility checks and terms.

5. Prices, Currency, and Taxes

Prices are displayed in the currency selected or shown on the website. The checkout page identifies the order currency and total amount payable.

Applicable taxes, shipping charges, and other disclosed charges are calculated or displayed at checkout. Your bank or payment provider may charge currency-conversion or international transaction fees.

For international orders, import duties, customs charges, and local taxes are the customer’s responsibility unless expressly included in the checkout total.

If a pricing error affects your order, we may cancel the affected item and issue a refund, or contact you for approval before proceeding at a corrected price.

6. Promotional Codes

Promotional codes must be used within their stated validity period and are subject to the conditions of the promotion.

Unless expressly stated otherwise, promotional codes:

• Cannot be applied to previous purchases.

• Cannot be combined with other promotional codes or offers.

• Have no cash value.

• Cannot be transferred or resold.

Changes to a promotion will not retroactively change the agreed price of an accepted order.

7. Shipping and Processing

Ready-made products

Unless a different processing timeframe is disclosed before purchase, in-stock orders placed before 5 PM Eastern Time, Monday through Friday, ship the same business day.

Orders placed after the cutoff, on weekends, or on holidays ship on the next business day, subject to any processing exception disclosed before purchase.

During major launches or peak periods, processing may take up to seven business days where that timeframe is disclosed before purchase.

Made-to-order products and preorders

Made-to-order products and preorders follow the production and shipping timeframe disclosed on the relevant product page or at checkout. The same-day shipping cutoff does not apply to these products.

If we cannot ship within the promised timeframe, we will notify you and offer the delay-consent or cancellation and refund options required by applicable law.

Shipping rates and delivery estimates

FINI offers free standard ground shipping on qualifying orders over $75 to eligible addresses in the contiguous United States and Canada. Alaska and Hawaii are excluded.

Other shipping methods and destination-specific charges are displayed at checkout.

Processing time is separate from carrier transit time. Carrier delivery estimates are estimates unless expressly identified as guaranteed. Customs processing, weather, and carrier disruptions may affect delivery.

8. Shipping Addresses and Lost Packages

Customers are responsible for providing a complete and accurate delivery address. Please contact info@finibrand.com immediately if an address needs correction. We cannot guarantee changes after an order enters fulfillment.

Once FINI has correctly dispatched an order to the address provided, customers must initiate missing, lost, stolen, or damaged-in-transit package claims directly with the shipping carrier.

To the extent permitted by applicable law, FINI is not responsible for packages lost or stolen after correct dispatch. FINI can provide available tracking information and shipment documentation to support a carrier claim.

For a package marked delivered but not located, check the delivery area, household members, building staff, and neighbors, then contact the carrier.

Shipping insurance and signature confirmation apply only where expressly included or purchased for the shipment.

This section does not exclude FINI’s responsibility for our own fulfillment errors or any customer rights or remedies that cannot lawfully be excluded.

9. Returns, Exchanges, and Refunds

Purchases made directly through www.finibrand.com are subject to our Refund, Exchange and Return Policy.

That policy explains return eligibility, deadlines, product condition requirements, fees, final-sale exclusions, and available refund or exchange options.

Any product-specific restriction must be clearly disclosed before purchase. Merely describing a release as a “drop” does not automatically make every product in that release final sale.

Final-sale restrictions do not remove rights or remedies that apply by law to defective, damaged, incorrectly supplied, or materially misdescribed products.

For an incorrect item or a product that arrives defective or damaged, contact info@finibrand.com promptly with your order number, a description of the issue, and photographs where available.

Products purchased through a retailer, marketplace, or other authorized seller are subject to that seller’s purchase and return policies. Contact the original seller for assistance.

10. Product Registration and Limited Releases

Where offered, FINI product registration allows customers to submit product and purchase information associated with a serial number.

Registration does not create an additional warranty, extend a return period, or change the applicable purchase terms unless expressly stated.

Edition sizes and serial-number details apply to the specific release identified. FINI may offer other versions, sizes, materials, or colorways unless the release description expressly states otherwise.

11. Privacy

Personal information is handled according to FINI’s Privacy Policy, accessible through the website footer.

Providing information for an order, account, or product registration does not by itself constitute consent to receive marketing text messages.

12. Email and Text Messages

We may send service communications needed to process your order, provide shipping updates, respond to inquiries, or manage your account.

Marketing emails and text messages are sent according to your consent preferences and applicable law.

Where you opt in to FINI marketing texts:

• Consent is not a condition of purchase.

• Message frequency varies.

• Message and data rates may apply.

• You may reply STOP to unsubscribe or contact info@finibrand.com for assistance.

You may unsubscribe from marketing emails using the unsubscribe link provided. Opting out of marketing does not prevent necessary order or account communications.

13. Intellectual Property

Website content, including FINI branding, logos, photographs, graphics, videos, text, and other materials, is owned by FINI or used with permission.

You may browse the website for personal, noncommercial purposes. You may not reproduce, sell, alter, or commercially use protected content without permission, except where permitted by law.

Nothing in these terms grants ownership of FINI’s intellectual property. Third-party trademarks belong to their respective owners.

14. Acceptable Use

You agree to use the FINI website only for lawful purposes. You must not:

• Submit fraudulent orders or knowingly provide false information.

• Attempt to access another person’s account or restricted website systems without authorization.

• Introduce viruses, malicious code, or other harmful software.

• Disrupt the website’s operation, interfere with its security, or bypass access restrictions.

• Infringe the intellectual property, privacy, or other legal rights of FINI or others.

• Collect personal information about other website users without lawful authorization.

• Use bots or other automated tools to manipulate purchases, bypass purchase limits, or interfere with other customers’ access.

• Use website forms or communication features to send spam, threats, or abusive content.

FINI may restrict or suspend website access where reasonably necessary to address a violation of these terms, protect customers or website security, or comply with applicable law.

Restricting website access does not remove any rights or remedies you may have concerning an existing purchase.

15. Third-Party Services and Links

The website may include third-party payment services, financing options, return portals, or external links.

Those providers may have separate terms and privacy policies. FINI does not control external websites or guarantee their content or availability.

16. Website Disclaimers and Liability

We make reasonable efforts to keep website information accurate and the website available, but uninterrupted or error-free operation is not guaranteed.

To the extent permitted by applicable law, the website and its informational content are provided on an “as available” basis.

To the extent permitted by applicable law, FINI is not liable for indirect, incidental, special, or consequential losses arising from website use.

Nothing in these terms excludes liability that cannot legally be excluded, limits mandatory consumer rights, or removes remedies FINI must provide for defective products or its own failure to fulfill an order.

17. Governing Law and Disputes

These terms are governed by the laws of the State of New York, except where mandatory laws provide otherwise.

Subject to applicable law and any mandatory consumer jurisdiction rights, disputes arising from these terms may be brought in the state or federal courts located in New York County, New York.

18. Changes to These Terms

We may update these terms periodically. The date at the top of this page identifies the latest revision.

Changes apply prospectively and will not retroactively remove rights associated with an existing purchase. An order remains subject to the purchase terms disclosed when it was placed, except where otherwise required by law or agreed with the customer.

19. General Provisions

These terms, together with the policies and product-specific conditions referenced here, form the agreement governing website use and direct purchases from FINI.

If a provision is found unenforceable, the remaining provisions continue to apply. A failure to enforce a provision does not waive the right to enforce it later.
